Terms of Service

The bonniezhou.com website (the "Site") is comprised of various web pages operated by Bonnie Zhou. bonniezhou.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of bonniezhou.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

Bonnie Zhou (and bonniezhou.com) offerings Fine Art Paintings, Reproductions, and other products or services.

RIGHTS TO ARTWORK AND IMAGES

All artwork, images, and graphics are the sole property of Bonnie Zhou and may not be used by any third party without written permission. Copying or reproducing artwork created by Bonnie Zhou (as seen on bonniezhou.com, or elsewhere) is strictly prohibited without written permission from the artist.  

Bonnie Zhou retains all rights to all artwork until it has been purchased by a private or public collector at which time the collector receives the right to display the artwork in their home or business.  

Bonnie Zhou retains all rights to the image of all artwork including the rights to the image of sold & commissioned original paintings.   

Bonnie Zhou retains the right to make reproductions of any and all artwork created by Bonnie Zhou UNLESS THE COLLECTOR HAS PURCHASED THE FULL OR PARTIAL RIGHTS TO THE ARTWORK in addition to purchasing the original painting. If you own an original painting and would like to discuss purchasing further rights, displaying the work in a public space, or nullify my right to reproduce, please contact hello@bonniezhou.com.

Collectors of reproductions have the right to display the artwork in their home or business but retain no other rights to the artwork.

Any image of the interior which includes the artwork in a 3rd party publication (such as social media, magazine, or book) must come with attribution (artwork title, artists name).

All other uses must be agreed to in advance in writing. 

ELECTRONIC COMMUNICATIONS

Visiting bonniezhou.com or sending emails to Bonnie Zhou constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

YOUR ACCOUNT

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Bonnie Zhou is not responsible for third party access to your account that results from theft or misappropriation of your account. Bonnie Zhou and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

CHILDREN UNDER THIRTEEN

Bonnie Zhou does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use bonniezhou.com only with permission of a parent or guardian.

THIRD PARTY SERVICES

bonniezhou.com may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of Bonnie Zhou and Bonnie Zhou is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Bonnie Zhou is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Bonnie Zhou of the site or any association with its operators.

Certain services made available via bonniezhou.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the bonniezhou.com domain, you hereby acknowledge and consent that Bonnie Zhou may share such information and data with any third party with whom Bonnie Zhou has a contractual relationship to provide the requested product, service or functionality on behalf of bonniezhou.com users and customers.

NO UNLAWFUL OR PROHIBITED USE/INTELLECTUAL PROPERTY

You are granted a non-exclusive, non-transferable, revocable license to access and use bonniezhou.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to Bonnie Zhou that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair Bonnie Zhou or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Bonnie Zhou or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Bonnie Zhou content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Bonnie Zhou and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Bonnie Zhou or our licensors except as expressly authorized by these Terms.

INTERNATIONAL USERS

Bonnie Zhou products and services (and bonniezhou.com) are controlled, operated and administered from our studio within the USA. If you access the site from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Bonnie Zhou content accessed through bonniezhou.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations. 

LIABILITY DISCLAIMER

This site isn’t perfect. Nor are we, the studio team or Bonnie Zhou. There may be inaccuracies, errors, typographical mistakes, and all sorts of messes on this website and in the studio content in general. We reserve the right to change all of it — the whole website. Every word.

Bonnie Zhou shall not be held liable for any direct, indirect, incidental, special, or consequential damages caused by this website, Shopify.com, or any third party. If you are not happy with this website, you don’t have to use it.

SECURITY

Payment information is not retained by Bonnie Zhou and we take precautions to protect your information during this process. When you submit sensitive information via the website, your information is protected both online and offline.

Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way through a Payment Processing System (Stripe or Paypal, depending on our preference at checkout).

Privacy Policy

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from bonniezhou.com (the “Site”).

PERSONAL INFORMATION WE COLLECT

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

DO NOT TRACK

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

YOUR RIGHTS

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.
Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
